Stage 3 Deep Cleaning of Oil Spill

Yesterday BP officials set forth a plan to continue beach cleaning proceedures. Begining Monday October 18th, 6am to 6pm daily, heavy equipment will resume cleaning operations on the beach. The SCAT Team (Shoreline Cleanup Assessment Team), will remove tar balls and oil patches that are up to 18 inches below the sand surface. They will be sifting sand and removing particals larger than 3mm in diameter. Once the SCAT team identifies an area considered to be clean, a NRDA Team (Natural Resource Damage Assessment) will inspect the area to insure this area is acceptable. The process will continue until all reasonable particles are removed. It is the goal of these groups to have the beach 100% filtered by January 1, 2011. Mayor Tony Kennon will not be satisfied untill a longterm plan of both ongoing oil recovery and beach renourishment is agreed by our city and the BP officials.

Caribe Happenings!

There is a lot happening at Caribe Resort! Just finishing up from a successful Shrimp Festival weekend and starting another active weekend today.

Caribe Resort is the site of the Wet Docks for Thunder on the Gulf. The parking lot has be completed for the Outcast Charter business and currently the crane is putting the race boats in the water. In accordance with the developer we have installed a new fence that will stretch from the tennis courts on the west side of the B tower to the boat docks. We will be dismantling the wood gate and fence in the coming days. Races are on Friday and Sunday so don’t miss the action.

In Gulf Shores this weekend there will be a Bon Jovi concert on Friday, October 15th and Brad Paisley on Sunday, October 17th.

On Novermber 4th Cobalt will be the site of the IFA National Redfish Championship fishing tournament. The following weekend Cobalt will be the site of the IFA National Kayak Redfish Tournament.

On the East side of the property, two of the last three houses are being removed. The developer is making plans for this area and as soon as these are complete we will let you know.

Caribe COA Amendment to condo docs. VERY IMPORTANT

Re: Proposed Amendment to Caribe Condominium Homeowner’s Association Documents (HIGH IMPORTANCE TO CARIBE RESORT PROJECT)
The Board of Directors is recommending a proposed amendment to the Caribe Condominium Association Documents that would restate the minimum length of a rental guest stay from (1) day to a minimum stay of (3) days. This proposal is to assist Caribe Owners in getting refinancing and helping new buyers with initial financing. It will lift some of the restrictions the lending institutions have on financing for Caribe Condominiums. This information is located in the condo docs under the following:
Offering Statement for Caribe Resort, A Condominium,
Orange Beach, Alabama
According to Section 35-8A-403 of the Code of Alabama. See page 14 of 17 paragraph (15.)
Reads as follows:
(… A minimum rental or leasing period is (1) day.)
Proposed Change:
(… A minimum rental or leasing period is (3) days.)

According to Section 35-8A-403 of the Code of Alabama
(15) Units may be leased or rented by the Unit Owners; and the rights of any tenant is hereby made subject to the power of the Association to prescribe reasonable rules and regulations relating to the leasing or rental of a Unit and to enforce the same directly against a tenant or other occupant by the exercise of such remedies as the Board of Directors deems appropriate, including eviction. Each Unit Owner who shall lease or rent his Unit irrevocable empowers the Association or its managing agent to enforce the rules and regulations and to terminate the lease and evict any tenant or occupant who fails to comply with the rules and regulations. The Association, the Board of Directors, or any agent thereof, shall not become liable to any Unit Owner or any person who sublets a Unit, or other party for any loss of rents or other damages resulting from the reasonable exercise of the provisions of this paragraph. Nothing to the contrary withstanding, a Unit owner is primarily responsible for the acts or omissions of its family, tenants, guests, invitees, or occupants. Individual rooms located within a Unit shall not be leased or rented. The minimum rental or leasing period is one (1) day.

BP Claims Caribe Realty Rental Owners

If you signed up for Grant, Sanders and Taylor Accountants to submit your loss of rental income for your BP claim this program is now over. Mr. Feinberg has taken over the program effective August 23rd and will no longer allow the claims for a rental company to be bundle. You should have recieved a letter stating this and what you need to do to continue the claim process. Caribe Realty will continue to supply the necessary information to assist you as the claim process develops. Specifically you do need to submit a new claim sheet and all historical documantation will transfer. This can be done on line at www.gulfcoastclaimsfacility.com.

Secondly, many of you have recieved a check in the mail for loss of rental income. This is considered emergency money but does not seem to follow any statisical basis on which BP came up with the amount each rental unit has recieved. By cashing the check this does not limit your claim in any way if you may choose to pursue litigation against BP and or anyone else associatied with this disaster.

Back by popular demand we have customized our reservations system to offer “single unit look up”. Now as an owner or guest you can query the data base to look up a specific unit for a specific time of occupancy. This is a great tool to help market your specific property.

Coming Events!!

The summer is winding down and most kids are back in school. Now is a great time to plan a weekend get away here at the coast. We have several events planned along the Gulf Coast for the fall and specifically here at Caribe and hope you, your family and friends can make it down.

September 6th – Labor Day Weekend – John Mayer concert at the Wharf. Caribe Realty will be offering free tickets for guests if they stay over Monday night September 6th for the concert.

September 25th – Hank Williams will also be at the Wharf with the Rowdy Friends concert. Ticket packages are avalable thru Caribe Realty.

October 7th – 10th – Shrimp Festival – This is a perfect time to enjoy the gulf coast.

October 12th – 17th – Thunder on the Gulf returns! Caribe will be the site of the wet slips and alot of free action right here at Caribe Resort.

Caribe Realty Claims Process

Early in the summer Caribe Realty offered to have Grant, Sanders and Taylor Accountants bundle the claims for Caribe Realty Rental properties. You had to sign a release and we would then provide GS & T the information necessary for the claim. They were just notified by BP that the bundling of claims would no longer be possible under Feinberg’s plan. If you have not sent your release in by now it is too late. We apologize for this late notice but GS & T just found out last night that this change would take place. As a Caribe Realty rental owner you can still process a claim and we will still provide you with the information, but it cannot be bundled as before. If you have sent this in prior to 4pm today your claim will be processed according to what was originally offered.

It appears that with Feinberg at the helm the processing will operate different than before. We will keep you up to date if anything else changes.

Feinberg in Orange Beach, Friday July 30, 2010

Kenneth Feinberg to hold Public Meeting at Orange Beach Rec Center

July 28, 2010 – Orange Beach, AL (OBA) – Mr. Kenneth Feinberg, the Washington attorney who will take over BP’s $20 billion claim fund within the next few weeks, will be in Orange Beach to discuss the claims process.

The meeting will be Friday, July 30, 2010, from 7am—8am at the Orange Beach Recreation Center and is open to the public. The Rec Center is located at 4849 Wilson Boulevard in Orange Beach, at the corner of Wilson Boulevard and Canal Road.

Outcast Charter Vote passes

In the July 20th Orange Beach City Council meeting, the council passed the amendment to approve a modification to the Caribe PUD allowing the establishment of Outcast Charters. One council member added an amendment that that would allow the developer to request maintaining this business when appling for the development of Tower A. It was also discussed that the fence proposed would be an an adequate barrier to trespassers on to Caribe Resort property. The developer agreed it would be a suitable fence.

Outcast Charter July 20th City Council Vote

Dear Caribe Resort Condominium Owner,

On July 20th 2010 at 5:00pm the Orange Beach City Council will be holding a public hearing at Council Chambers and vote on an amendment to ordinance No. 172 zoning ordinance, case #0504-PUDA-10 – Planned Unit Development major modification – Outcast Charter, Caribe PUD Modification – Larry Wireman – applicant: Outcast Charter.

The following is requested:

– Convert 18 boat slips from residential use to commercial use.
– Up to ten (10) Wave Runners
– Up to (2) 12 – person pontoon boats
– Up to six (6) – 6 person charter boats
– Up to three (3) – 20 person charter boats
– Provide gravel parking for 125 vehicles including paved ADA compliant / handicap parking. Note: this will be landscaped and include a barrier fence to Caribe Tower B.
– Construct a 1200 square foot 30’ x 40’ Charter Outcast building.
– Maintain option to build 312 unit condominium tower.

There is no request or permit for a fueling station. The slips used will be docks located between Cobalt Restaurant and Caribe Tower B. People using this area will not have access to Caribe Resort unless they are owners or owner’s guests of Caribe Resort.
